What should be assessed before filing a trademark?

The starting points are the sign you want to protect, its proposed owner and the goods or services it will cover. A clearance search can reveal potential conflicts; it is not an approval. The SIC examines the application and decides whether to grant registration.

Common questions

Does incorporating a company also protect its trademark?

These are separate procedures. Commercial registration and trademark protection serve different purposes. We consider both so that the business name and brand strategy work together.

Does a clearance search guarantee registration?

No. It helps assess earlier rights, but the SIC makes the decision and objections or oppositions may arise. Our advice identifies risks without promising registration.

Are official fees included in your legal fees?

Our proposal distinguishes legal fees from official charges and specifies the classes and proceedings covered. A dispute or appeal requires its own agreed scope.
